LvR Photography – Terms of Service

 

By booking a session with Louis van Rensburg (LvR Photography), you agree to the following terms and conditions:

 

1. Image Use and Copyright

Client Permission: By signing, the Client grants LvR Photography permission to use images for:

Marketing & Advertising: Use on the Photographer’s website, social media, portfolio, and promotional materials.

Display: Showcase on the Photographer’s online platforms.

Photographer’s Rights:

The Photographer will use images for marketing and promotion only, not for resale or commercial purposes without Client consent.

The Photographer retains copyright of all images. The Client may use images for personal purposes but cannot sell or alter them without permission.

The Client may request removal of images from the Photographer’s platforms at any time in writing.

 

2. Event-Specific Permissions

For events with three or more attendees (e.g., weddings, birthday parties, or gatherings), the Client agrees to allow LvR Photography to capture and post images of all guests at the event on social media and marketing platforms. This consent is granted on behalf of all attendees, as the Client acknowledges that they have informed the guests that photography will take place.

3. Booking Confirmation

Non-Refundable Deposit: An 80% non-refundable deposit is required to secure your session date. The session is not confirmed until this deposit is received, even for last-minute bookings (within 14 days).

 

Final Payment:

For bookings made more than 14 days in advance, the remaining 20% is due 14 days before the shoot.

For bookings within 14 days, full payment is required upon booking. If the final payment isn't received, the Photographer will not be obligated to perform the shoot, and the deposit will be forfeited.

 

4. Rescheduling and Cancellation Policies

Rescheduling Policy:

More than 14 Days:

Rescheduling is allowed without penalty.

Within 14 Days:

Can reschedule with at least 7 days’ notice. Rescheduling with less than 7 days’ notice is treated as a cancellation.

Cancellation Policy:

30 Days or More: The 80% deposit is forfeited.

Within 30 Days but More than 14 Days: The remaining 20% is due.

Within 14 Days: The full session fee is due.

No-Show: The full session fee will be retained.

 

Cancellation by Photographer:

If necessary, the Client will receive a full refund or the session can be rescheduled.

 

Weather Conditions:

The Photographer may reschedule outdoor sessions due to weather conditions affecting image quality or safety.

 

5. Liability

Equipment Failure:

The Photographer’s liability for camera or equipment malfunction is limited to a refund of the session fee or a reshoot if possible.

Lost or Damaged Photos:

If photos are lost or damaged, liability is limited to the total session fee, and a reshoot may be offered if feasible.

Travel Fees:

The Client is responsible for all travel-related expenses, including non-refundable costs if the event is canceled or rescheduled.

High-Cost Events:

For significant events (e.g., weddings), liability is limited to a partial refund of the session fee in case of cancellation or failure to deliver services.

6. Image Editing and Licensing

The Client may not edit or alter images without written consent from the Photographer. The Client is granted a personal-use license, but commercial use is prohibited without consent.

7. Disputes

Any disputes arising from this agreement will be settled through mediation before any legal action is taken. If the Client does not wish for images to be used, they must notify the Photographer within 2 days of receiving their photos.

8. Photographer’s Agreement

The Photographer will use images positively and professionally, respect the Client’s privacy, and address requests for image removal or changes promptly.
